This Refund Policy for Juiced IO INC (doing business as Juiced) (“Juiced,” “Company”, “we,” “us,” or “our”) applies to Payments made through the website https://juiced.io (the “Site”) and the Juiced app (the “App”). 

The terms of this Refund Policy govern the relationship between you (hereinafter “you” or “Customer”) and Juiced regarding your Payments made through the App and Site. Which company is a party to this Refund Policy, concluded with a specific Customer, depends on the chosen method of payment. The name and legal address of Juiced will be shown on the receipt provided to the Customer after the completion of a successful payment.

REFUND SUMMARY

These refund rights are separate from any legal rights you may have if Services are either faulty or misdescribed. Even if you don’t qualify for a refund under this Policy, you may still be eligible to receive a refund. You may check your eligibility by contacting Customer Support

The refund program described in this Policy may expire and/or be terminated by us at any time and/or for any reason. For users who have made eligible payments, refund requests will be considered under this Policy for up to fourteen days after this Policy has been terminated or expired, unless otherwise required by applicable law.

1. OUR SERVICES

1.1 Software. Juiced provides you with software from the Juiced Site which is delivered to you via a download or accessible via a web browser. “Software” includes any subscription you sign up for through our Site or App. 

2. PAYMENTS

2.1 By signing up for Juiced, you acknowledge that your transaction will be with Juiced directly and not with Stripe, PayPal or any other payment processor we use to accept payments. You further acknowledge that only upon the successful verification by us of the authenticity and sufficiency of the information you provide in connection with your Payment, we will then begin processing your Payment. 

2.2 Payments are typically processed instantly, but may take up to 2-5 days to complete depending on your chosen payment method. 

2.3 Once your Payment has been processed, we will send you a confirmation email (if possible) using the email address provided to us in your personal account or submitted to us. 

2.4 This confirmation email will serve as your electronic Payment receipt and will contain information about your Payment (see Section 4.1 below). The contract between you and Juiced will only be formed when you receive your Payment confirmation email. 

2.5 If we are unable to supply you with Our Services (for example, because that Service is no longer available, or because of an error in the price), Juiced will inform you of this by email and we will not process your Payment. 

3. SERVICE PRICE 

The price of your Payment will be quoted including any applicable taxes and shipping costs. We currently offer 3 pricing plans that cost $25, $50 and $75. Additional fees apply based on the plan you choose. 

4. SERVICE DELIVERY 

4.1 After the completion of a successful Payment of Our Services, the fulfilment process will be started. The gap between payment for the Service and the receipt of a Fulfilment Notification may take 2-5 days. Where such service is made available, the Fulfilment Notification will contain a download link that will allow you to download Software. 

4.2 Occasionally, the delivery of the Service may be affected by a cause or event outside of our control, including but not limited to: downtime of our App or Site, or downtime of 3rd party services our App and Site relies on for the fufliment or functionality of Our Services; an invasion, terrorist attack or threat of terrorist attack; war (whether declared or not) or threat or preparation for war; fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disaster or act of God; limited access to public or private telecommunications networks; the acts, decrees, legislation, regulations or restrictions of any government. Juiced will not be responsible for any situations that affect the delivery in the case that such situations are beyond Juiced’s control.

4.3 Delivery of the Service shall be completed when the Service is delivered to the email address you provide in your Payment. 

4.4 Services are fulfilled to you based on the information which you provide, and you are responsible for the accuracy of such information. If any regulations are breached due to inaccurate information provided by you, then you are responsible for such a breach.

5. FRAUD PREVENTION 

We are attentive to any facts that indicate the presence of fraud. We reserve the right to deny access to our servers, or to refuse delivery of any Service, if we establish a fact pattern that indicates the illegal use of the Software or any payment facility, or any other action aimed at obtaining the Software which the user is not entitled to claim. Please note that if your Juiced Account or any other Juiced related account is banned, or if we determine (in our absolute discretion) that you have breached the terms of Juiced’s Legal Agreements, you do not have the right to demand a refund of Services.

6. REFUND RIGHTS FOR DIGITAL SERVICES

In addition to any statutory rights you may have, digital services or downloadable application Payments are eligible for a refund within 14 days of the Payment provided that it is eligible as this policy describes. 

This refund eligibility applies even if you live in the EU / EEA / UK and have waived your right of withdrawal. Digital services payments and physical product payments made outside of our App or Site or our in-App browser are subject to the applicable retailer’s refund policy. Please read the applicable retailer’s refund policy before making any purchases in conjunction with our App or Site. Refund or warranty claims in respect of such products should be directed to the relevant retailer in the first instance. 

7. EU / EEA / UK RIGHT OF WITHDRAWAL SUMMARY

If you live in the European Union, the European Economic Area, or the UK, you have a right to withdraw from certain Payments without giving a reason within 14 days from the day you received access to Our Services. To exercise your right of withdrawal, you must unambiguously declare your desire to withdraw from your payment during the 14 day withdrawal period, for instance, by notifying Juiced of your decision to withdraw from your Payment within 14 days of such payment. A description of the Payments that are not subject to this withdrawal right is set forth below. 

You will be reimbursed within 14 days using the same method of payment you used to make your Payment (unless you have expressly agreed otherwise) if your Refund Request is approved. 

8. EU / EEA / UK RIGHT OF WITHDRAWAL INELIGIBILITY 

The EU / EEA / UK right of withdrawal described above is not applicable to the following types of Payments: Payments of digital services after the services have been fully performed if the performance has begun with your prior consent and your acknowledgement that you will lose your right of withdrawal once the services have been fully performed; Payments of goods made to your specifications or clearly personalized; Payments of goods which are, after delivery, according to their nature, inseparably mixed with other items; Payments of sealed audio, video recordings, or software which are unsealed after delivery; or Payments of digital content if the performance has begun with your prior consent and your acknowledgment that you will lose your right of withdrawal.

9. WHAT PAYMENTS QUALIFY FOR A REFUND

Subject to this Policy, you may receive a refund on annual or monthly subscription payments made through our Site or App, so long as you submit your request within fourteen days of being charged and we determine that you have not violated our Terms of service. This clause is subject to all other terms set out in this Policy, such as, but not limited to, section 10 below.

10. WHAT PAYMENTS DO NOT QUALIFY FOR A REFUND

We do not offer refunds on any Payments:

– that were collected as a result of your selling activities (selling fees);

– for lifetime or one time subscription;

– for physical or digital products or services from 3rd party retailers within our App or Site (e.g: a pair of shoes purchased from Nike via our in-App browser). WE DO NOT SELL ANY OF THE GOODS RECOMMENDED WITHIN OUR APP, THEY ARE RECOMMENDATIONS ON 3RD PARTY SITES;

– if the refund request is made more than fourteen days after the date of Payment, unless otherwise required by applicable law;

– of previously refunded subscriptions. 

11. HOW TO REQUEST A REFUND

To qualify for a refund, you must submit your request via one of the official Juiced channels listed below. Please ensure when submitting your request that you provide as much context as possible so we can best assist you. At the bare minimum, you should provide 1) your email (if not already provided), 2) the date of payment, and 3) the reason for your refund request. Before requesting a refund, please ensure you qualify for one by reading sections 9 and 10 above.

12. WHAT HAPPENS WHEN A REQUEST IS INITIATED

When you initiate a refund request, you will lose your access to the App while we process your request. During that time, you will not be able to interact with the App or any content or Payments you’ve made within it. If your refund request is denied, you will regain access to the App.

13. REFUND PROCESSING TIME

It typically takes us no more than five days to review, verify, and process refund requests upon approval. Once a refund is processed, depending on the payment method, it can take up to 10 days for the refund to be accredited to your account. If a refund request is granted, we will credit you through your original payment method(s).

14. HOW TO VIEW PREVIOUS PAYMENTS

To view invoices and previous payments, go to https://payments.juiced.io, scroll down to “Payments” and click “View” or “PDF” to get more information on each payment.

You can also view previous payments by searching for “Juiced” in your bank accounts transaction page. 

15. WHY YOUR REFUND REQUEST MAY BE REJECTED

Our refund system will not grant refund requests if they fall within any of the exceptions set out above or are otherwise exempted from this Policy. We may also deny refund requests if we detect irregularities and/or potential abuse of our systems (or our policies), such as multiple attempts to refund subscriptions over a period of time, etc.

If you would like to get a refund on a subscription that has been determined ineligible for a refund under this Policy, or if you feel that you are otherwise entitled to a refund which was denied, please contact Customer Support. Nothing in this Policy shall be deemed to limit any of your applicable statutory rights.

16. LIMITATION OF LIABILITY 

16.1 Juiced does not exclude or limit in any way our liability to you where it would be unlawful to do so. To the extent permitted by law, our total liability to you in respect of all other foreseeable losses arising under or in connection with the EULA and this Refund Policy, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the total price of a) 6 months of payments, or b) $600 USD, whichever is less. 

16.2 You agree not to use the Services for any illegal purposes, and Juiced has no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. 

17. REPRESENTATIONS AND WARRANTIES

17.1 Juiced represents and warrants to you that we will take all action necessary to solve your issue in good faith. All refund requests or disputes will be investigated, taking into account the legislation of your country. 

17.2 The Software is provided by Juiced on an “as is” and “as available” basis without warranty or condition of any kind. All other warranties related to the Software are hereby excluded to the maximum extent permitted by law. 

18. DISPUTES

18.1 This Refund Policy (as well as the EULA) are governed by the laws applicable in the State of Delaware and shall be construed accordingly, without prejudice to any other imperative provision of law more favorable to the customer applicable in the country of habitual residence of the customer. 

18.2 Mindful of the high cost of legal dispute, not only in dollars but also in time and energy, both you and Juiced agree to the following dispute resolution procedure: In the event of any controversy, claim, action, or dispute arising out of or related to any Payment, or the breach, enforcement, interpretation, or validity of this Refund Policy and (or) EULA or any part of it (dispute), the party asserting the dispute shall first try in good faith to settle such dispute by providing written notice to the other party by registered mail describing the facts and circumstances (including any relevant documentation) of the dispute, and allowing the receiving party 30 days from the date of mailing to respond to the dispute.

18.3 Unless you indicate otherwise in your notice, Juiced shall respond to your notice using your last-used billing address or the billing and/or shipping address that we have. 

18.4 In the event that Juiced is unable to resolve the dispute, you and Juiced both agree that the parties shall resolve their dispute through binding arbitration in Lewes, Delaware, before a single arbitrator. The arbitration shall be administered by JAMS pursuant to its Streamlined Arbitration Rules and Procedures, and the arbitrator shall apply the laws applicable in the State of Delaware. The arbitration shall proceed solely on an individual basis without the right for any claims to be arbitrated on a class action basis. You hereby waive your right to a class action lawsuit.
